These Terms of Service ("Terms") govern your use of the UltraWISP LLC ("UltraWISP," "we," "us," or "our") website and internet services. By using our website or services, you agree to these Terms.
Services
UltraWISP provides internet access services to residential and business customers in West Virginia. Service availability, speeds, and pricing are subject to your location and the plan you select.
Acceptable Use
You agree not to use our services to:
- Violate any applicable local, state, or federal law
- Transmit any material that is unlawful, threatening, abusive, or harassing
- Interfere with or disrupt our network or services
- Attempt to gain unauthorized access to any systems or networks
- Distribute spam, viruses, or other harmful content
- Resell, redistribute, or otherwise share your internet connection with any individuals, households, businesses, or entities not residing at or operating from the service address on your account — including but not limited to extending service to neighboring properties, operating a commercial hotspot, or providing connectivity to others for compensation or free of charge
Fair Use
UltraWISP internet plans include unlimited data with no monthly data caps. However, our network is a shared resource, and all plans are subject to a fair use expectation. "Unlimited" means your service is intended for normal, reasonable residential or business internet use — it is not intended for use that is disproportionate to typical usage patterns, that places excessive or sustained demand on network resources, or that negatively impacts network performance for other customers or the operation of our network management systems.
Examples of usage that may be considered a violation of this policy include, but are not limited to: operating servers intended for high-volume public use, sustained maximum-bandwidth consumption over extended periods, reselling or redistributing your internet connection to third parties, or any use that degrades service quality for other customers.
If we determine, at our sole discretion, that a customer's usage is negatively impacting our network or other customers' service, we will attempt to work with the customer to resolve the issue. If the issue cannot be resolved, we reserve the right to throttle, suspend, or terminate service. This policy is not intended to limit normal, everyday internet use — including streaming, gaming, video calls, working from home, and downloading — and has never needed to be enforced in the history of UltraWISP's operations to the date of this Terms of Service update.
Service Availability
While we strive to provide uninterrupted service, we do not guarantee that our services will be available at all times. Scheduled maintenance, weather events, equipment failures, and other factors may cause temporary service interruptions.
Billing and Payment
Services are billed monthly. Payment is due by the date specified on your invoice. Late payments may result in service suspension. We do not require long-term contracts — all residential plans are month-to-month.
Limitation of Liability
To the fullest extent permitted by West Virginia law, UltraWISP shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services, including but not limited to loss of data, revenue, or business opportunities.
Termination
Either party may terminate service at any time. You may cancel by contacting us. We may suspend or terminate your service if you violate these Terms or fail to make timely payments.
Changes to Terms
We may update these Terms from time to time. Material changes will be communicated to active customers. Continued use of our services after changes constitutes acceptance of the updated Terms.
Governing Law
These Terms are governed by the laws of the State of West Virginia, without regard to conflict of law provisions.
